Late ang 1701Q Ko: What to Do If You Missed the Deadline
5 min read
Missed your 1701Q? Breathe. File it as soon as you can. For an 8% freelancer, a late return is almost always fixable, and cheaper than people fear. What it costs depends on one question: did you owe tax for that quarter, or was it ₱0?
First: you're a Micro Taxpayer, so the penalties are reduced
The 8% rate is only for people earning up to ₱3,000,000 a year, so every 8% freelancer is a Micro Taxpayer under the Ease of Paying Taxes Act (RA 11976). The BIR's own EOPT summary confirms the reduced rates for micro and small taxpayers:
| Penalty | Standard | Micro / small taxpayer |
|---|---|---|
| Surcharge | 25% of the tax due | 10% |
| Interest | 12% per year | 6% per year |
If you owed ₱0 (still under the ₱250,000 exemption)
The surcharge and the interest are both computed on the unpaid tax, and 10% or 6% of ₱0 is ₱0. So there's no surcharge and no interest.
You still have to file the return, because an unfiled quarter stays open in the BIR's system even at ₱0. The BIR also charges a compromise penalty, a fixed amount by your gross receipts: ₱1,000 up to ₱50,000, ₱3,000 up to ₱100,000, ₱5,000 up to ₱500,000. It's not reduced for micro taxpayers.
If you owed tax
A late return with tax due costs:
- a 10% surcharge on the tax due,
- 6% interest per year on the tax due, counted from the deadline until you pay, and
- a compromise penalty from the BIR's schedule, by the tax due (below).
Example: ₱10,000 of tax, filed and paid one month late.
| Charge | Amount |
|---|---|
| Tax due | ₱10,000 |
| 10% surcharge | ₱1,000 |
| 6% interest, one month | about ₱50 |
| Compromise penalty | ₱3,000 |
| Total to pay | about ₱14,050 |
The interest keeps adding up every day, so filing this week costs less than filing next month. RaketTax shows the exact figure for your return when it's past due.
The compromise penalty comes from the BIR's published schedule (Annex A of RMO 7-2015). It is not reduced for micro taxpayers. With tax due, it depends on the tax unpaid:
| Tax unpaid | Compromise penalty |
|---|---|
| up to ₱5,000 | ₱1,000 |
| ₱5,001 – ₱10,000 | ₱3,000 |
| ₱10,001 – ₱20,000 | ₱5,000 |
| ₱20,001 – ₱50,000 | ₱10,000 |
| ₱50,001 – ₱100,000 | ₱15,000 |
| ₱100,001 – ₱500,000 | ₱20,000 |
With ₱0 due, it depends on the gross receipts on the return: ₱1,000 up to ₱50,000, ₱3,000 up to ₱100,000, ₱5,000 up to ₱500,000, and ₱10,000 up to ₱5,000,000.
What to do, step by step
- Find the quarter and the figures. Total what your clients paid you from January to the end of the quarter you missed. The 1701Q is cumulative.
- File the late 1701Q the same way as an on-time one, through eBIRForms (step-by-step guide). The BIR's Online eBIRForms System computes penalties automatically on returns submitted after the deadline.
- Pay the tax and penalties together if you owed anything: through GCash, Maya, an online bank or an Authorized Agent Bank (paying through GCash or Maya).
- Keep the BIR's confirmation email (the TRRC) and your payment receipt.
- Missed more than one quarter? File each one, oldest first. Don't skip a missed quarter and just put its income in the next one: the missed return is still due on its own.
- Got a letter or notice from your RDO? Follow our guide to late filing, penalties and open cases.

Frequently asked questions
I missed the deadline but my tax due was ₱0. Do I still need to file?
Yes. With ₱0 due there's no surcharge and no interest, but the return still has to be filed to close the quarter, and the RDO may charge a compromise penalty.
Can I just include the missed quarter's income in my next 1701Q?
The next 1701Q is cumulative, so it will include that income. But the missed quarter's return is still due on its own and stays open until it's filed. File it first.
How much is the compromise penalty?
It's a fixed amount from the BIR's published schedule (Annex A of RMO 7-2015): by the tax due, starting at ₱1,000 up to ₱5,000 of tax, or by gross receipts if nothing was due. See the tables above. It isn't reduced for micro taxpayers.
Will a late 1701Q stop me from getting a visa or loan?
A filed late return with its TRRC is far better than a missing quarter. See how to get a BIR-stamped ITR for a visa.
